• David M. Hawkins, 24, of Colfax was charged with public intoxication (third offense) Friday morning shortly after he went to the Jasper County Jail to turn himself in for a 10-day jail sentence for the same crime. According to a sheriff’s office report, Hawkins made contact with the jail staff at 5:30 a.m. and went outside shortly after. A sheriff’s office spokeswoman said Hawkins left the building and dumped the public cigarette ashtray on the sidewalk, and when jail staff instructed him to clean up the refuse, the official reportedly smelled an odor of alcohol coming from Hawkins. The report states a preliminary breath test recorded Hawkins’ blood alcohol content at .175, and he admitted to jail staff he had consumed alcohol before his arrival. Court records show Hawkins has three previous public intoxication convictions from October 2006 to July 2010. He was placed in jail.

• Daniel N. Smith, 42, of Newton was summoned and cited for driving while license suspended and other traffic-related violations at 10:55 p.m. Thursday after she was stopped for speeding in the 5400 block of Highway T12. According to a sheriff’s office report, a patrolling deputy observed Smith traveling 74 mph in a 55 mph zone. She was cited for failure to post SR22 insurance and unlawful use of driver’s license during the stop and released to appear in court.

• Aaron A. Wagner, 35, of Grinnell was arrested and charged with OWI (first offense) and possession of drug paraphernalia during a traffic stop early Friday morning in the 12400 block of Highway 6 East. According to a sheriff’s office report, a patrolling deputy observed Wagner’s vehicle traveling 77 mph in a 55 mph zone. Investigators said a glass smoking pipe containing burnt marijuana reside was found in the vehicle’s center console during a search. Wagner reportedly admitted it was used to smoke the controlled substance. The officer also noted that Wagner had an odor of alcohol during the stop, and a Datamaster test later conducted at the Jasper County Jail found his blood alcohol content to be .143. Wagner reportedly told officers that he had consumed one beer 90 minutes prior to the traffic stop. He was taken to jail.

A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty. It is the policy of the Newton Daily News to release the names of individuals charged with a crime who are 15 and older.
