Newton Police Department

• Patti L. Gardner, 59, of Newton, was charged with public intoxication at 9:32 p.m. Dec. 28 in the 700 block of First Avenue East. According to the Newton Police Department, officers were responding to a motor vehicle accident when Gardner, who was not associated with the accident, approached Newton police. Officers observed Gardner having bloodshot, watery eyes and the odor of an alcoholic beverage coming from her person. Gardner admitted to consuming alcohol that night. Police asked Gardner to do a standard field sobriety test and she refused. Officers also requested a sample of her breath for a preliminary breath test and Gardner refused. Newton police placed Gardner under arrest and advised her of her right to a chemical test and she advised that she wished to take the chemical test. Officers attempted to administer the DataMaster test but Gardner was unable to complete it. Gardner was arrested and taken to the Jasper County Jail.
