• Derrick S. Bayliff, 41, of Newton was charged with public intoxication and possession of drug paraphernalia after officers were dispatched at 1:30 a.m. Saturday to 208 E. Fourth St. S. on a report of an intoxicated individual. Bayliff walked down the stairs, with his pants below his knees, and when he saw the patrol car he went back up the stairs. The officer then called him down, where Bayliff performed field sobriety tests, which he failed. A field test resulted in a BAC of .033. He was taken to jail.

• Alex W. Bentley, 15, of Newton was charged with possession of alcohol under the legal age after an officer witnessed reckless driving at 9:17 p.m. Sept. 14 at Newton Senior High School. When he approached the group he noticed they were all chewing gum, but the officer still smelled alcohol. Bentley then furnished a bottle of Hawkeye vodka and a bottle of Black Velvet. Everyone’s BAC in the group was between .01 and .00.

• Richard B. Cavin, 23, of Knoxville was charged with operating a motor vehicle while intoxicated after he was stopped at 2:15 a.m. Sunday at 200 W. Second St. N. A test at the police station resulted in a BAC of .176. He was taken to jail.

• Gary A. Dudley, 37, of Des Moines was charged with operating a motor-vehicle while intoxicated and cited for failure to maintain control and leaving the scene of an accident after officers were dispatched at 12:46 a.m. Saturday to South Eighth Avenue East and East Fourth Street South on a report of an accident. While on their way to the scene of the accident, where Dudley had drove his car into a tree, he attempted to leave the scene. Officers located him, attempted to perform field sobriety tests on him, but he couldn’t perform simple commands. At the police station, he was attempting to pick up objects off the ground that were not there. He was taken to jail.

• Jessica C. Jolley, 21, of Newton was charged with accessory after the fact after officers were dispatched at 10:35 p.m. Sept. 13 to 300 E. 21st St. S. on a report of an accident. After an accident, Jolley transported the intoxicated driver to his residence. She was released to appear in court.

• Ashley M. McCormick, 20, of Newton was charged with driving while license revoked after officers stopped her at 11:07 p.m. Sept. 21 at 400 S. Eighth Ave. E. Upon pulling her over, the officer discovered her license had been revoked. She was placed in jail.

• Daryl B. Merrill, a 19-year-old homeless man, was charged with second-degree theft and second-degree criminal mischief after officers were dispatched on Sept. 5 on a report of the theft of a car at Tasty Freeze. The owner of a 2008 Chevy Impala reported the car stolen along with an uncashed check in the car. Once Merrill was located on Sept. 18, he told officers he cashed the check at a bank in Newton for $450. He was taken to jail.

• Joseph L. Richards, 26, of Newton was charged with domestic assault after officers were dispatched at 6:19 a.m. Sunday to 202 W. 10th St. N. on a report of a domestic assault. He was placed in jail.

• Robert D. Stanton, 39, of Newton was charged with second-degree fraudulent practices after Stanton collected $7,718 from the Iowa Workforce Department after they alleged Stanton was employed during the time he was receiving these benefits. He was later cited and released to appear in court.

• Jennifer M. Stevenson, 17, of Newton was charged with criminal mischief after officers were dispatched at 11:21 a.m. Thursday to 700 N. Fourth Ave. E. Stevenson was directed several times to use her iPad, which was given to her by the school district, and she kicked a hole in the wall because she didn’t like using the iPad. She allegedly caused $200 in damage to the wall.

• Joan B. Wilcox, 50, of Newton was charged with harassment after officers were dispatched at 4:30 p.m. Thursday at 222 W. Ninth St. S. on a report of Wilcox saying offensive things to the victim. Wilcox was yelling at the victim and continued to do so after she was asked to stop. She was taken to jail.

• Steven J. Wilker, 59, of East Moline Ill. was cited for failure to maintain control and operating with an expired license after officers were dispatched at 3:55 p.m. Friday to the 167.5 mile marker on I-80. Wilker was driving eastbound when he sneezed and lost control of his semi-truck, driving off into the ditch and hitting trees.

• Jason M. Winchell, 43, of Newton was charged with public consumption after officers were dispatched at 1:45 p.m. Sunday to 115 E. 17th St. N. on a report of a male smoking marijuana and drinking. Upon arrival, officers spoke with the Richards who admitted to going to Hy-Vee to purchase the beer and drinking the beer. He was released to appear in court.

• A Newton 14-year-old male was charged with fourth degree possession of stolen property after officers were dispatched at 7:14 p.m. Sept. 8 to 412 S. 11th Ave. W. on a report of a theft. The victim’s phone, valued at $281.94, and a carton of cigarettes had gone missing. Officer’s determined the phone was at the 14-year-old male’s house, who gave the phone back, stating he bought it from a friend for $20.

A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
